Terms and Conditions

Your contract with Green Getaways Private Limited and its partners, hereafter referred to as GG Pvt. Ltd. (“we,” “us,” or “our”), is based on these Booking Conditions, as well as our privacy policy, our Website Terms of Use, and any other written information we brought to your attention before we confirmed your booking.

They spell out our individual rights and obligations, so please read them carefully. References to “you,” “they,” “them,” “their,” “he,” “she,” and “your” in these Booking Conditions encompass the first identified person on the reservation as well as other relevant parties on whose behalf a reservation is made or any additional person to whom a reservation is added or transferred.

By making a reservation, the first person listed as the “Lead Traveler (Traveler 01)” on the reservation agrees on behalf of all other people listed on the reservation that they have read and agree to be bound by the following terms and conditions:

(1.1) have read these Booking Conditions and general information pages (including the sections headed “Trip Details,” “Itinerary,” “FAQs”, “Dates and Prices” and “Inclusions and Exclusions” contained in our brochure and/or on our website); and have read;

(1.2) respect and acknowledge the dangers associated with adventure travel;

(1.3) consent to our use of their personal information in accordance with our Privacy Policy and is authorized to provide us with their personal information, including any applicable special categories of data (like details on their medical conditions, disabilities, and dietary needs);

(1.4) are above 18 years old and, in cases where services have an age restriction, the person placing the order certifies that they, along with any other party members, are of legal age to book trips with GG Pvt. Ltd.;

(1.5) do not have any disabilities or underlying medical issues that would prohibit them from fully participating in the tour, hike, or climb – Before making a reservation, please get in touch with us if you have a medical condition or disability that may or might affect your tour arrangements so that we can provide you advice on the suitability of your chosen accommodations and associated services;

(1.6) on behalf of all the people listed on the booking, accept financial responsibility for payment of the booking.

TRIP & BOOKING CONTRACT

After GG Pvt. Ltd. receives the necessary deposit, a written confirmation of your reservation and a contract are issued. Please carefully review your confirmation, and immediately notify GG Pvt. Ltd. or a designated agent of any errors or omissions. Please double-check that names match exactly what is on the corresponding passport.

CONFIRM BOOKING

Unless otherwise specified prior to receiving your deposit, a deposit of 25% of the trip’s total cost for each participant is required to activate your reservation when booking through the website. Before making a reservation, speak with the travel consultant assigned to you about any installment payment plans.

Forms of Payment: When making a reservation on the website, a deposit is required. Subsequent payments can be made online, by personal check or cashier’s check made out in USD to Green Getaways Pvt. Ltd., by bank transfer to the company’s address, or via digital invoices that are sent to you after making a reservation.

When you make a reservation request, we will consider it a “not-guaranteed” reservation because it is merely tentative at this time. Only once we give you a “Welcome” email to let you know that your ‘on request’ booking has been confirmed, is your reservation accepted and definite. At this time, a legal agreement between you and us is formed.

Any acknowledgement of your booking request that we give to you in the interim for reservations made through our website is not a confirmation of your reservation.

We (and our travel agents) reserve the right, in our sole discretion, to refuse any booking.

If you make a reservation on our website, we’ll get in touch with you via email. As a result, you need to regularly check your email. If we are unable to reach you by email for any reason, we may still reach out to you by phone and/or mail. You might need to email some documents. Email communication is included when “send” and “in writing” or similar expressions are used under certain scenarios. If you need to get in touch with us for any of the reasons listed in these booking conditions (for instance, to seek an adjustment), you should do so by email. LATE/LAST-MINUTE BOOKINGS

Small group sustainable trips are our area of expertise, therefore the earlier you book, the better. We also provide a private trek on your chosen dates.

We retain the right to pass along any additional costs incurred as a result of the late nature of the booking for reservations made less than 30 days prior to the start of your tour (or earlier for climbs/customized trips). We will inform you of any such additional costs at the time that you make your reservation.

The contract between you and us becomes effective for reservations made less than 30 days before your tour (or sooner for climbs or customized trips) as soon as we or our authorized travel agent has received full payment

Please Note:

If you make a last-minute or “on request” reservation, we highly advise against booking any flights or making any other travel plans until you have received written confirmation from us that your chosen trip is still available. If you choose to make travel plans before getting written confirmation of our availability from us, we will not be liable to you for any returns of the expenses you have already paid in the event that your preferred booking is not truly available.

PAYMENT FOR YOUR TOUR

No later than 30 days before the start of your trek, the total amount payable, including any surcharges in effect at the time, must be received by us (or our authorized travel agent). Prior to the start of your journey, full payment is required for climbs, expeditions, and customized tours. When this is the case, you will be informed when making the reservation.

We reserve the right to treat your reservation as canceled by you if we do not receive this amount in full and on time. In that event, the cancellation fees outlined in clause 8 below will be due.

By using a credit or debit card, you can pay the deposit and the entire amount. We accept Maestro/Solo, Visa, and MasterCard. On our booking page, there can be other payment options.

PRICING

Our travel expenses are presented with a default pricing in USD. You can ask your designated GG Pvt. Ltd. salesperson for the cost in your local currency.

We have the right to make price changes for unsold excursions whenever necessary and to fix pricing mistakes for confirmed trips. Additionally, we reserve the right to raise the cost of confirmed travel only to cover increases that are a direct result of adjustments in:

  1. the price of the carriage of passengers resulting from the cost of fuel or other power sources;
  2. the level of taxes or fees chargeable for services applicable to the trip imposed by third parties not directly involved in the performance of the trips, including tourist taxes, landing taxes, or embarkation or disembarkation fees at ports and airports; and
  3. the exchange rates relevant to the package.

These changes could affect airline prices, which are covered by our contracts with airlines (and their agents), local operators, and other transport companies, but they are not restricted to that.

However, if this means that you have to pay an increase of more than 8% of the price of your confirmed trip (excluding any insurance premiums, amendment charges, and/or additional services or travel arrangements), you will have the option of accepting a change to another trip if we are able to offer one (if this is of equivalent or higher quality you will not have to pay more but if it is of lower quality you will be refunded the difference in price), or canceling and receiving a full refund of all monies paid to us, except for any insurance premiums and any amendment charges and/or additional services or travel arrangements. Should you decide to cancel for this reason, you must exercise your right to do so within 7 days from the issue date printed on your final invoice. We will consider an appropriate refund of insurance premiums paid if you can show that you are unable to transfer or reuse your policy.

Should the price of your trip go down due to the changes mentioned above, then any refund due will be paid to you less an administrative fee of $100. However, please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place.

There will be no change made to the price of your confirmed trip within 30 days of your departure nor will refunds be paid during this period.

CUTTING YOUR TRIP SHORT

We are not required to reimburse the cost of any travel arrangements you have not utilized if you are obliged to shorten the itinerary for whatever reason. We will not provide you with a refund for the portion of your trip that was not completed or be liable for any additional costs you may incur if you shorten your trip and return home early in circumstances where you have no valid reason to complain about the quality of the accommodations and services offered. Your travel insurance may provide coverage for curtailment depending on the situation, so we advise filing any claims directly with them.

CANCELLATION POLICY

After we’ve sent you our email confirmation, if you need to amend any aspect of your reservation, you must contact us in writing as soon as possible. The Lead Traveler (Traveler 01) on the reservation should complete this. Even while we’ll try our best to help, we can’t promise that we’ll be able to make the requested adjustment.

All deposits are non-refundable and final. In the event of cancellation, we will keep your deposit on file for all time to be applied to a future trip or date. Please be aware that if the journey is delayed by more than a year, the cost may alter. Any flight changes or cancellations must be communicated by email to GG representatives.

Days prior to your arrival date to the trip destination and cancellation fees:

30 Days or less = FULL Balance paid/100%; only 25% used as a deposit for the next trip that is scheduled

31-60 Days = 75% of the total trip cost per person

61 – 99 Days = 50% of the total trip cost per person

100-365 Days = 25% of the total trip cost per person

365+ Days = 25% lifetime deposit

Please note that the above does not apply to bookings that are transferred to a future departure date, in which case the original tour start date (before transfer) will be used to calculate any incurred charges.

Cancellation fees if rescheduled for a future date within 72 hrs of initial cancellation

30 Days or less = 75% Fee only; 25% used as deposit for the next trip that is scheduled

31-60 Days = 50% Fee only; 50% used as deposit for the next trip that is scheduled

61 – 99 Days = 25% Fee only; 75% used as deposit for the next trip that is scheduled

100-365 Days = 0% Fee only; 25% used as deposit for the next trip that is scheduled

365+ = 0% Fee only; 25% used as deposit for the next trip that is scheduled

Within 72 hours of giving cancellation notice for the initial trip, the client must choose a new date. 100% of the payment will be non-refundable and non-transferable as per the above cancellation fee with reference to the days previous to the arrival date if the new date is not received by GG Pvt. Ltd.

Please note that you can reschedule for the same trip but prices may change and we will ask you to cover the increase. If you wish to cancel then the regular cancellation policy as per clause 8 will apply.

Any unsold hotel rooms, airline tickets, or other tour services or amenities will not be refunded or otherwise compensated. You are aware that unexpected things could happen while you are traveling, including but not limited to political unrest, natural disasters, and accidents or illnesses in remote areas without access to medical care. To the fullest degree allowed by Nepalese law, you agree to take all risks related to the trip.

If you need to cancel your trip within 30 days or less of the start date due to a major impediment that is beyond your control, such as COVID travel restrictions, a pandemic, lockdowns, strikes, political unrest, terrorism, etc., you will have the option to apply any money you have already paid to another date or another trip of equal value, with the exception of any costs already incurred during the preparation of the trek. We recognize that this is a challenging circumstance, but we’ll do our best to collaborate with you and reach a smooth conclusion.

It is strongly recommended that comprehensive travel insurance is taken out which includes cover against cancellation charges.

CHANGES IN THE ITINERARY BY YOU

If you decide to quit a trip on your own accord after it has started, there will be no reimbursements given. If you must leave a trip against your will for whatever reason, GG Pvt. Ltd. may issue a refund at its discretion. For any lodging, transportation, sightseeing, meals, or services that are not used, there will be no reimbursements given. Please be aware that these terms could change.

If your plans change after receiving confirmation, you must give GG Pvt. Ltd. written notice at least 60 days before your departure date. Any expenditures or additional fees incurred as a result of the modification will be paid at that time. You are responsible for covering all costs associated with flight cancellations as well as any administrative fees that might result from unanticipated changes to your arrival time or ability to start the journey. Due to the nature of trekking, the weather, local regulations, and other factors beyond the control of GG Pvt. Ltd. or its partners, GG Pvt. Ltd. retains the right to cancel the trek or amend the route. If this happens, you will be given the option of another excursion of comparable quality. However, no refund will be allotted.

Adjustments are contingent on availability. If you cancel a reservation, you can ask for a credit voucher for the amount you paid. This must be applied to a new booking within three months of the date of issuing. The voucher is not exchangeable for cash, may only be used for one booking, and is not transferable. If the price of the new booking is less than the value of the credit voucher, no refund or additional credit voucher will be given.

We shall consider it a cancellation on your part if we are unable to fulfill your request and you decide not to proceed with the original reservation. According to clause 8, a cancellation charge can be due.

IF WE CHANGE OR CANCEL YOUR TRIP

Changes: If we make changes to your tour, we’ll try to let you or your travel agency know as soon as we reasonably can if there’s still time before your departure, but we won’t be held responsible for it. For instance, changing your outbound or return flights by less than 12 hours or switching to a different hotel with a higher grade of service are examples of inconsequential modifications.

These kinds of excursions require flexible planning, both from the participants and the organizers. The daily itineraries/agendas and the excursion’s final goals are regarded as objectives rather than as binding agreements. You must agree to this flexibility and that GG Pvt. Ltd. cannot be held liable for cancellations, delays, changes in the program, or costs incurred as a result of international or domestic flight cancellations, automobiles, or other modes of transportation before you can sign up for one of our excursions. Major roadblocks include, but are not limited to, strikes, illness, bad weather and other natural disasters, war, epidemic, quarantine, and political restrictions. Any such costs incurred, which may or may not be covered by your own insurance depending on the situation, are your responsibility. To make sure you receive the right coverage, you must be sure to disclose all of these things and conditions to your insurance carrier, including any planned travel to high altitudes. You must obey the leader’s authority when participating in an expedition of this kind because they are speaking on behalf of GG Pvt. Ltd.

The tour’s conduct, schedule, and goals are ultimately decided by the tour guide. Your assent to this is indicated by your signature on our reservation/booking form. You may be asked to leave the tour without the right to a refund if the leader determines that your actions or physical condition endangers the safety, welfare, and overall well-being of the group (which are the paramount considerations). This decision will be made after consulting with the trek medical professional, if one is provided.

If there is time before departure and we need to make a significant alteration or cancellation, we will notify you as soon as possible and give you the option of:

(10.1) (for significant changes) accepting the changed arrangements; or

(10.2) having a refund of all amounts paid except the non-refundable deposit paid at the time of initial booking; or

(10.3) accepting an offer of alternative travel arrangements of a comparable or higher standard from us, if available (at no extra cost); or

(10.4) if available, accepting an offer of alternative arrangements of a lower/higher standard, with a refund/add-on of the price difference between the original arrangements and the alternative arrangements; or

(10.5.) transfer the paid amount as a credit voucher to another person with your consent to be used towards a trip that is at least the value of the initial trip that was booked.

Within 7 days of our offer, you must inform us of your decision. We will get in touch with you once again to ask for a notice of your choice if we don’t hear from you within 7 days. We’ll assume that you’ve decided to accept the adjustment or alternative booking arrangements if you don’t react once more.

If we are unable to fulfill a sizable portion of the arrangements you have reserved with us after you have left, we will, if at all possible, make substitute arrangements for you at no additional cost, and if those substitute arrangements are of a lower caliber, we will give you a suitable price reduction.

FOR COMPLAINTS

While we make every effort to ensure that your tour arrangements go successfully, if anything goes wrong, please let our tour guide know as soon as possible, and she or he will try to make things right. If the issue cannot be resolved and you wish to file a formal written complaint with us, you must do so within 28 days of the conclusion of your stay, together with your booking reference and any other pertinent details. Please be concise and direct in your letter. This will help us recognize your issues more immediately and respond to you more swiftly.

Note: If you don’t follow the instructions in this clause, we and the relevant provider may not be able to properly investigate your complaint, which will have an impact on your rights under this contract.

COMPLIANCE AND INSURANCE

You consent to observing all local laws, ordinances, immunization requirements, and entrance requirements established for travel to the target country. Failure to comply or reluctance to do so will result in cancellation, which will be subject to the standard cancellation procedure detailed in Clause 8 above.

You are solely responsible for making all necessary preparations, such as getting the necessary visas (aside from those for Tibet), and GG Pvt. Ltd. disclaims all liability should these not be finished in time for departure.

You must have insurance that includes the expense of repatriation and helicopter rescue if you become too unwell or injured to continue in order to participate in one of our trips. You must get an insurance plan that is intended to cover this kind of travel. Throughout the trip, you must travel with proof of insurance (such as your insurance certificate). You will be obliged to purchase an appropriate coverage at that time if you are unable to show proof of insurance prior to leaving on your trip. If you fail to comply, you may be prevented from continuing the trip and will not be eligible for a reimbursement for any services that were not rendered. (Please review any description pages for more information on insurance, immunizations, gear, and essentials.)

Insurance Disclaimer*

In extreme circumstances, your insurance must pay for any and all emergency evacuations without requiring prior authorization from your insurance company. Without prompt action, the situation might suddenly get worse in mountainous areas. Green Getaways maintains the right to take these actions in the interest of guests’ safety and is not obligated to seek permission from the insurance companies before doing so. As a result, Green Getaways will not be held responsible in any way for any costs associated with organizing the evacuation for the guest’s safety. The guests are entirely responsible for coordinating with their insurance to cover the responsibilities. Guests understand that any costs incurred by Green Getaways during the process of rescuing and evacuating the guests are to be covered either by the guests’ insurance provider or by the guests themselves.

PASSPORT AND VISA INFORMATION

When traveling with GG Pvt. Ltd., you must have a current passport and the necessary visas. Please make sure your passport is still valid six months after the vacation ends. It is your obligation to make sure you have the appropriate visas for the destinations you plan to visit. If you are denied entry to a country or location because you do not have the proper visa papers, GG Pvt. Ltd. is not liable.

RISKS INVOLVED

You accept that traveling with GG Pvt. Ltd. needs some flexibility, and that the itinerary, lodging, and mode of transportation are all subject to change at any time owing to unforeseen local conditions. GG Pvt. Ltd. may shorten, alter, or reroute any trip if it decides it is necessary to change the itinerary for any reason. If any modification is made for a reason outside GG Pvt. Ltd.’s control, you will be responsible for any additional costs. These modifications are binding. Before it is confirmed to go, GG Pvt. Ltd. maintains the right to cancel any trip you have booked. Unless specified otherwise, a journey is assured to run once it has at least 1 fully paid traveler. Any flights you take as part of your vacation will be governed by the specific airline’s General Conditions of Carriage and Conditions of Contract, which will be noted on your airline ticket. These flights will also be governed by international law, which frequently places restrictions on the airlines’ liability to passengers for things like death or physical harm, delays, and baggage loss or damage. If necessary, GG Pvt. Ltd. maintains the right to substitute different types of vehicles, transporters, and/or aircraft.

GG Pvt. Ltd. disclaims responsibility for any loss or damage on whatever basis. GG Pvt. Ltd. does not assume liability for any loss, damage, or accident to any luggage and property, even though we will always treat your luggage and personal items with great care while in our control (such as when carried by porters, yaks, and horses).

HEALTH, DISABILITIES, AND MEDICAL CONDITIONS

Although we do not specialize in providing tours for people with disabilities, we will make every effort to meet your needs. Please inform us before you confirm your booking if you have any medical conditions or disabilities that could affect your active participation in your tour, the tour arrangements of any other person, or if you have any special needs because of any medical conditions or disabilities (including any that affect the booking process) so that we can help you decide whether the proposed tour is appropriate for you and/or help you make the booking. In any case, you must provide us with complete information at the time of booking and keep us updated if/when your condition or impairment changes.

If a health issue or impairment arises after your booking has been confirmed and has the potential to interfere with your active participation in your tour or the plans for any other person, you must notify us right away.

We may ask you to provide a doctor’s note attesting to your fitness to take the trip of your choice. If we can’t suitably accommodate the needs of the person or people in question, we will, acting fairly, either decline to confirm your booking or, if you didn’t provide us with all the necessary information at the time of booking, we will cancel it when we learn the necessary information and impose the necessary cancellation fees.

FLIGHTS/TRANSPORT/DELAYS

Any changes to your international flight’s arrival or departure times must be immediately communicated to GG Pvt. Ltd. The client is responsible for covering any costs necessary to make the modification at the destination.

The clients shall be responsible for any costs incurred as a result of modifications, delays, or cancellations of domestic or foreign flights.

FOREIGN OFFICE ADVICE

It is your responsibility to inform yourself of Foreign Office recommendations regarding the security of the nations and regions you will be visiting and to base your decisions on those recommendations. Events outside the control of GG Pvt. Ltd. may include recommendations from the Foreign Office to stay away from or depart a specific nation.

BOOKING FROM PARTNER WEBSITES

These agreements and the terms of the third-party website will also apply to any adventure/trip packages that are booked through such websites. GG Pvt. Ltd. will not be responsible for any refunds for the trips bought from third-party websites, including but not limited to TourRadar, Bookmundi, Viator, Travel Zoo, etc. They will be bound by the terms and regulations of the individual website from which the guests booked the Green GetawaysTrips.

The terms and conditions of Green Getaways are accepted by visitors who reserve their excursions through third-party marketplaces.

FREE TRIP GIVEAWAY/ PROMOTIONAL CAMPAIGNS TERMS AND CONDITIONS

The trip packages shown on the Green Getaways website might not necessarily match the free trip giveaway package or other promotional trip packages. They might have been built with that goal in mind, fitting all the requirements for meeting the gift redemption requirements. The gift will be transferred to another person chosen at random who meets all the requirements if a person does not meet the requirements for redemption.

Giveaways of free vacations are not transferable and may only be used by the original recipient. Within two years after the day they received the gift, the winner may admit to utilizing it whenever it is convenient for them. We will infer that a recipient has lost interest in using their gift if they don’t use it within two years of getting it.

* Other terms apply for the trip. GG Pvt. Ltd. reserves the right to make changes to the terms at their discretion.

All participants are required to read and accept these terms and conditions. Participants understand that there are risks and dangers associated with participating in the trip excursion, which is organized by GG Pvt. Ltd. The participant hereby consents to and accepts all associated risks, hazards, and conditions, as well as all associated costs that may follow.
